1. Champ d’application et vendeur
Les présentes conditions générales régissent les achats, réservations, offres, commandes groupées et bons cadeaux conclus avec Swiss Art Gallery par le site, par écrit ou à la galerie. Le vendeur contractuel est l’exploitant identifié dans les mentions légales.
Le client peut sauvegarder ces conditions avant de confirmer. En cochant la case prévue à cet effet, il accepte la version affichée au moment de sa demande. Les règles impératives protégeant le consommateur demeurent réservées.
2. Œuvres, descriptions et attribution
Les œuvres sont décrites de bonne foi à partir des informations disponibles, de l’examen de la galerie et, le cas échéant, de recherches documentaires. Les termes tels que « attribué à », « atelier de », « entourage de », « école de », « d’après » ou « dans le goût de » expriment un degré d’attribution et non une certitude absolue d’auteur.
Les photographies cherchent à restituer fidèlement l’œuvre, mais un écran peut modifier les couleurs et les contrastes. Les dimensions sont données avec une tolérance raisonnable ; l’état, le cadre, les restaurations visibles ou particularités liées à l’âge sont précisés dans la fiche ou sur demande. Le client peut demander des images complémentaires, un rapport d’état ou une visite privée avant de s’engager.
3. Prix et fiscalité
Les prix sont indiqués en francs suisses (CHF). Swiss Art Gallery n’étant actuellement pas assujettie à la TVA, aucune TVA suisse n’est facturée séparément. Le prix de l’œuvre, les frais de livraison applicables ou la nécessité d’un devis sont présentés avant l’engagement final.
Les éventuels droits de douane, taxes d’importation ou frais perçus dans le pays de destination sont à la charge du client, sauf mention écrite contraire.
4. Commande et conclusion du contrat
L’envoi d’un formulaire, d’une demande de paiement ou d’une commande constitue une demande d’achat. Le contrat est conclu lorsque Swiss Art Gallery confirme par écrit la disponibilité de l’œuvre et l’acceptation de la commande. Une confirmation technique de réception ne vaut pas encore acceptation si elle le précise.
Le paiement s’effectue par le moyen proposé, notamment TWINT, ou selon les instructions écrites de la galerie. L’œuvre peut être temporairement bloquée pendant la vérification du paiement. À défaut de paiement dans le délai indiqué, la galerie peut libérer l’œuvre après en avoir informé le client.
Si l’œuvre n’est finalement pas disponible ou si la galerie ne peut exécuter la commande, les montants déjà encaissés pour cette commande sont remboursés.
5. Réservations et offres
Réservation
Une réservation bloque en principe l’œuvre pendant 24 heures. L’acompte affiché lors de la demande est imputé sur le prix final. Si la galerie ne peut exécuter la vente, il est intégralement remboursé. Si le client ne finalise pas dans le délai convenu, la réservation devient caduque ; le sort de l’acompte est examiné de bonne foi selon les frais et le préjudice effectivement justifiables, après contact avec le client.
Offre de prix
Une offre transmise par le client ne constitue ni un achat ni une réservation : l’œuvre peut rester disponible. Si la galerie accepte l’offre ou émet une contre-proposition, le client dispose du délai communiqué, en principe 48 heures, pour confirmer. La confirmation avec acceptation des présentes conditions forme alors une demande ferme et déclenche la réservation pendant le paiement.
6. Acquisition de plusieurs œuvres
Pour préserver une expérience sereine, la première étape regroupe uniquement les œuvres et le mode de remise. Le récapitulatif, les éventuels frais de livraison et le total sont présentés à la deuxième étape, avant toute confirmation contractuelle. Une livraison hors de Suisse fait l’objet d’un devis personnalisé.
7. Retrait, livraison et transfert des risques
Le retrait privé à St-Prex est gratuit sur rendez-vous. Pour une livraison en Suisse, le coût applicable est affiché ou confirmé avant l’engagement. Pour l’étranger ou un transport particulier, un devis doit être accepté séparément.
Le client doit fournir une adresse exacte et permettre la remise. La galerie prépare un emballage adapté et peut mandater un transporteur. Les risques sont transférés lors de la remise effective au client ou à la personne qu’il a désignée, sous réserve du droit impératif applicable. Le client est invité à signaler immédiatement tout dommage apparent et à conserver l’emballage et les preuves photographiques.
8. Bons cadeaux
Les bons cadeaux sont émis en CHF, avec un code individuel, pour un montant compris entre 20 et 5 000 CHF. Ils sont utilisables en une ou plusieurs fois, dans la limite du solde disponible, pendant dix ans à compter de leur émission. Ils ne sont pas remboursables en espèces, sauf obligation légale. Le détenteur doit protéger le code ; toute perte ou utilisation non autorisée doit être signalée rapidement.
9. Annulation et retour
Le droit suisse ne prévoit pas de délai général de rétractation pour les achats en ligne. Swiss Art Gallery n’accorde donc pas de droit de retour de convenance automatique, sauf accord écrit. Les droits impératifs éventuellement applicables au domicile d’un consommateur étranger demeurent réservés.
Une demande motivée peut toujours être adressée à la galerie ; une solution amiable sera recherchée lorsque l’état de l’œuvre et les circonstances le permettent.
10. État, vérification et garantie
Les œuvres anciennes ou de seconde main peuvent porter des traces normales d’âge, d’usage, de restauration ou d’encadrement, qui ne constituent pas un défaut lorsqu’elles ont été décrites ou sont usuelles au regard de la nature de l’objet. Le client doit examiner l’œuvre dès réception et signaler rapidement par écrit tout défaut non annoncé, avec photographies.
Les droits légaux en cas de défaut demeurent applicables. Aucune clause ne limite la responsabilité en cas de dol, faute grave ou autre responsabilité qui ne peut être exclue par la loi.
11. Authenticité, provenance et droits d’auteur
La qualification d’auteur et la provenance sont établies selon les connaissances raisonnablement disponibles au moment de la vente. Une attribution qualifiée n’est pas une garantie d’authenticité absolue. La facture reprend les éléments déterminants convenus. L’acquisition de l’objet matériel ne transfère aucun droit d’auteur, d’image ou de reproduction.
12. Données et communications
Les données nécessaires à la relation, au paiement, à la livraison et aux obligations comptables sont traitées conformément à la politique de confidentialité. Les communications électroniques et confirmations conservées par les parties peuvent servir de preuve de la transaction.
13. Droit applicable et règlement des différends
Le droit suisse est applicable, à l’exclusion de ses règles de conflit de lois. Les parties cherchent d’abord une solution amiable. À défaut, les tribunaux compétents selon le droit suisse sont saisis ; les fors impératifs dont bénéficie un consommateur restent entièrement réservés.

Diese Allgemeinen Geschäftsbedingungen gelten für Käufe, Reservierungen, Angebote, Sammelbestellungen und Geschenkgutscheine, die über die Website, schriftlich oder in der Galerie mit Swiss Art Gallery vereinbart werden. Vertraglicher Verkäufer ist der im Impressum bezeichnete Betreiber.
Der Kunde kann diese Bedingungen vor der Bestätigung speichern. Mit dem vorgesehenen Kontrollkästchen akzeptiert er die zu diesem Zeitpunkt angezeigte Fassung. Zwingende Verbraucherschutzbestimmungen bleiben vorbehalten.
2. Kunstwerke, Beschreibung und Zuschreibung
Die Werke werden nach Treu und Glauben aufgrund der verfügbaren Angaben, der Prüfung durch die Galerie und gegebenenfalls dokumentarischer Recherchen beschrieben. Begriffe wie „zugeschrieben“, „Werkstatt“, „Umkreis“, „Schule“, „nach“ oder „in der Art von“ bezeichnen den Grad der Zuschreibung und keine absolute Sicherheit hinsichtlich der Urheberschaft.
Fotografien sollen das Werk möglichst getreu wiedergeben; Bildschirme können Farben und Kontraste verändern. Masse verstehen sich mit angemessener Toleranz. Zustand, Rahmen, sichtbare Restaurierungen und altersbedingte Besonderheiten werden im Werkblatt oder auf Anfrage angegeben. Vor der Bindung können weitere Bilder, ein Zustandsbericht oder eine private Besichtigung verlangt werden.
3. Preise und Steuern
Die Preise sind in Schweizer Franken (CHF) angegeben. Da Swiss Art Gallery derzeit nicht mehrwertsteuerpflichtig ist, wird keine Schweizer Mehrwertsteuer separat ausgewiesen. Werkpreis, anwendbare Lieferkosten oder die Notwendigkeit einer Offerte werden vor der endgültigen Verpflichtung angezeigt.
Zölle, Einfuhrsteuern oder Gebühren im Bestimmungsland trägt der Kunde, sofern schriftlich nichts anderes vereinbart ist.
4. Bestellung und Vertragsschluss
Das Absenden eines Formulars, einer Zahlungsanforderung oder Bestellung gilt als Kaufanfrage. Der Vertrag kommt zustande, sobald Swiss Art Gallery die Verfügbarkeit des Werks und die Annahme der Bestellung schriftlich bestätigt. Eine rein technische Empfangsbestätigung gilt nicht als Annahme, wenn dies entsprechend ausgewiesen ist.
Die Zahlung erfolgt über das angebotene Mittel, insbesondere TWINT, oder gemäss schriftlicher Anweisung. Das Werk kann während der Zahlungsprüfung vorübergehend blockiert werden. Erfolgt die Zahlung nicht innerhalb der angegebenen Frist, kann die Galerie das Werk nach Benachrichtigung wieder freigeben.
Ist das Werk nicht verfügbar oder kann die Bestellung nicht ausgeführt werden, werden bereits für diese Bestellung erhaltene Beträge zurückerstattet.
5. Reservierungen und Angebote
Reservierung
Eine Reservierung blockiert das Werk grundsätzlich für 24 Stunden. Die angezeigte Anzahlung wird an den Endpreis angerechnet. Kann die Galerie den Verkauf nicht ausführen, wird sie vollständig zurückerstattet. Schliesst der Kunde nicht fristgerecht ab, verfällt die Reservierung; über die Anzahlung wird nach Kontakt mit dem Kunden nach Treu und Glauben und aufgrund tatsächlich belegbarer Kosten und Schäden entschieden.
Preisangebot
Ein Kundenangebot ist weder Kauf noch Reservierung; das Werk kann verfügbar bleiben. Nimmt die Galerie das Angebot an oder unterbreitet sie eine Gegenofferte, hat der Kunde die mitgeteilte Frist, grundsätzlich 48 Stunden, zur Bestätigung. Die Bestätigung unter Annahme dieser Bedingungen ist eine verbindliche Anfrage und löst die Reservierung während der Zahlung aus.
6. Erwerb mehrerer Werke
In der ersten Stufe werden nur die Werke und die Übergabeart zusammengestellt. Zusammenfassung, allfällige Lieferkosten und Gesamtbetrag erscheinen in der zweiten Stufe, vor jeder vertraglichen Bestätigung. Lieferungen ausserhalb der Schweiz werden individuell offeriert.
7. Abholung, Lieferung und Gefahrübergang
Die private Abholung in St-Prex ist nach Terminvereinbarung kostenlos. Für Lieferungen in der Schweiz werden die Kosten vor der Bindung angezeigt oder bestätigt. Auslandslieferungen und besondere Transporte bedürfen einer separat angenommenen Offerte.
Der Kunde stellt eine richtige Adresse und die Entgegennahme sicher. Die Galerie sorgt für geeignete Verpackung und kann einen Transporteur beauftragen. Die Gefahr geht mit der tatsächlichen Übergabe an den Kunden oder eine von ihm bezeichnete Person über, vorbehaltlich zwingenden Rechts. Sichtbare Schäden sind sofort zu melden; Verpackung und Fotos sind aufzubewahren.
8. Geschenkgutscheine
Gutscheine werden in CHF mit individuellem Code für Beträge zwischen CHF 20 und 5'000 ausgestellt. Sie können innerhalb des verfügbaren Guthabens einmal oder mehrfach während zehn Jahren ab Ausstellung verwendet werden. Eine Barauszahlung ist ausgeschlossen, soweit das Gesetz nichts anderes verlangt. Der Code ist zu schützen; Verlust oder unbefugte Nutzung sind unverzüglich zu melden.
9. Stornierung und Rückgabe
Das Schweizer Recht kennt kein allgemeines Widerrufsrecht für Onlinekäufe. Swiss Art Gallery gewährt daher ohne schriftliche Vereinbarung kein automatisches Rückgaberecht aus Gefälligkeit. Zwingende Rechte eines ausländischen Verbrauchers an seinem Wohnsitz bleiben vorbehalten.
Begründete Anliegen können der Galerie jederzeit unterbreitet werden; soweit Zustand und Umstände es erlauben, wird eine einvernehmliche Lösung gesucht.
10. Zustand, Prüfung und Gewährleistung
Ältere oder gebrauchte Werke können normale Alters-, Gebrauchs-, Restaurierungs- oder Rahmungsspuren aufweisen. Soweit beschrieben oder objekttypisch, gelten diese nicht als Mangel. Der Kunde prüft das Werk bei Erhalt und meldet nicht angekündigte Mängel rasch schriftlich mit Fotos.
Die gesetzlichen Mängelrechte bleiben anwendbar. Die Haftung für Absicht, grobe Fahrlässigkeit oder gesetzlich nicht ausschliessbare Fälle wird nicht beschränkt.
11. Echtheit, Provenienz und Urheberrecht
Urheberschaft und Provenienz werden nach dem im Verkaufszeitpunkt vernünftigerweise verfügbaren Wissensstand angegeben. Eine qualifizierte Zuschreibung ist keine absolute Echtheitsgarantie. Die Rechnung hält die vereinbarten wesentlichen Merkmale fest. Der Kauf des körperlichen Gegenstands überträgt keine Urheber-, Bild- oder Vervielfältigungsrechte.
12. Daten und Mitteilungen
Die für Geschäftsbeziehung, Zahlung, Lieferung und Buchführung notwendigen Daten werden gemäss der Datenschutzerklärung bearbeitet. Elektronische Mitteilungen und Bestätigungen können als Transaktionsnachweis dienen.
13. Anwendbares Recht und Streitigkeiten
Es gilt Schweizer Recht unter Ausschluss des Kollisionsrechts. Zunächst wird eine gütliche Lösung gesucht. Andernfalls sind die nach Schweizer Recht zuständigen Gerichte zuständig; zwingende Verbrauchergerichtsstände bleiben vollumfänglich vorbehalten.

These terms apply to purchases, reservations, offers, grouped orders and gift vouchers agreed with Swiss Art Gallery through the website, in writing or at the gallery. The contractual seller is the operator identified in the legal notice.
The customer may save these terms before confirming. By ticking the relevant box, the customer accepts the version displayed at the time of the request. Mandatory consumer-protection rules remain unaffected.
2. Artworks, descriptions and attribution
Artworks are described in good faith using available information, the gallery’s examination and documentary research where appropriate. Expressions such as “attributed to”, “studio of”, “circle of”, “school of”, “after” or “in the manner of” convey a degree of attribution and not absolute certainty of authorship.
Photographs aim to represent the work faithfully, but screens may alter colours and contrast. Measurements allow a reasonable tolerance. Condition, frame, visible restoration and age-related characteristics are stated in the record or on request. The customer may request more images, a condition report or a private viewing before committing.
3. Prices and tax
Prices are in Swiss francs (CHF). As Swiss Art Gallery is not currently registered for VAT, Swiss VAT is not charged separately. The artwork price, applicable delivery charges or the need for a quotation are shown before final commitment.
Customs duties, import taxes and charges in the destination country are payable by the customer unless otherwise agreed in writing.
4. Orders and formation of the contract
Submitting a form, payment request or order constitutes a request to purchase. The contract is formed when Swiss Art Gallery confirms in writing that the artwork is available and that the order is accepted. A technical acknowledgement alone is not acceptance where it says so.
Payment is made by the offered method, including TWINT, or in accordance with written instructions. The artwork may be temporarily held while payment is checked. If payment is not completed within the stated time, the gallery may release it after notifying the customer.
If the artwork is unavailable or the gallery cannot fulfil the order, amounts already received for that order are refunded.
5. Reservations and offers
Reservation
A reservation normally holds the artwork for 24 hours. The displayed deposit is credited against the final price. If the gallery cannot complete the sale, it is refunded in full. If the customer does not complete within the agreed period, the reservation lapses; after contacting the customer, the deposit is dealt with in good faith by reference to substantiated costs and actual loss.
Price offer
A customer offer is neither a purchase nor a reservation and the work may remain available. If the gallery accepts or counters, the customer has the stated period, normally 48 hours, to confirm. Confirmation with acceptance of these terms is then a firm request and holds the artwork during payment.
6. Acquiring several artworks
The first step groups only the selected works and handover method. The review, any delivery charge and the total are displayed at the second step, before contractual confirmation. Delivery outside Switzerland is subject to a personalised quotation.
7. Collection, delivery and risk
Private collection in St-Prex is free by appointment. Swiss delivery charges are displayed or confirmed before commitment. Overseas delivery and special transport require a separately accepted quotation.
The customer must provide an accurate address and enable delivery. The gallery prepares suitable packaging and may appoint a carrier. Risk passes on actual delivery to the customer or a person nominated by them, subject to mandatory law. Apparent damage should be reported immediately, with packaging retained and photographed.
8. Gift vouchers
Gift vouchers are issued in CHF with an individual code for values between CHF 20 and CHF 5,000. They may be used once or in parts up to the remaining balance for ten years from issue. They are not redeemable for cash unless required by law. The holder must protect the code and promptly report loss or unauthorised use.
9. Cancellation and returns
Swiss law provides no general cooling-off period for online purchases. Swiss Art Gallery therefore grants no automatic change-of-mind return right unless agreed in writing. Mandatory rights applying to a foreign consumer at their place of residence remain unaffected.
The gallery will nevertheless consider any reasoned request and seek an amicable solution where the artwork’s condition and circumstances permit.
10. Condition, inspection and warranty
Older or pre-owned works may show normal signs of age, use, restoration or framing. These are not defects where disclosed or usual for the object. The customer must inspect on receipt and promptly report any undisclosed defect in writing with photographs.
Statutory remedies for defects remain available. Nothing limits liability for fraud, gross negligence or any liability that cannot legally be excluded.
11. Authenticity, provenance and copyright
Authorship and provenance are stated according to knowledge reasonably available at the date of sale. A qualified attribution is not an absolute guarantee of authenticity. The invoice records the agreed material characteristics. Purchasing the physical object transfers no copyright, image or reproduction rights.
12. Data and communications
Data needed for the relationship, payment, delivery and accounting are processed under the privacy policy. Electronic communications and confirmations retained by either party may evidence the transaction.
13. Governing law and disputes
Swiss law applies, excluding conflict-of-law rules. The parties first seek an amicable solution. Failing that, the courts competent under Swiss law have jurisdiction; mandatory consumer forums remain fully reserved.

Il cliente può salvare le condizioni prima della conferma. Selezionando l’apposita casella accetta la versione visualizzata al momento della richiesta. Restano salve le norme imperative a tutela del consumatore.
2. Opere, descrizioni e attribuzioni
Le opere sono descritte in buona fede sulla base delle informazioni disponibili, dell’esame della galleria e, se opportuno, di ricerche documentarie. Espressioni quali «attribuito a», «bottega di», «cerchia di», «scuola di», «da» o «alla maniera di» indicano un grado di attribuzione e non una certezza assoluta sull’autore.
Le fotografie mirano a riprodurre fedelmente l’opera, ma gli schermi possono modificare colori e contrasti. Le dimensioni ammettono una tolleranza ragionevole. Stato, cornice, restauri visibili e caratteristiche dovute all’età sono precisati nella scheda o su richiesta. Prima di impegnarsi, il cliente può chiedere altre immagini, un rapporto sullo stato o una visita privata.
3. Prezzi e fiscalità
I prezzi sono espressi in franchi svizzeri (CHF). Poiché Swiss Art Gallery non è attualmente assoggettata all’IVA, l’IVA svizzera non viene fatturata separatamente. Il prezzo dell’opera, le spese di consegna applicabili o la necessità di un preventivo sono indicati prima dell’impegno finale.
Dazi, imposte d’importazione e spese nel paese di destinazione sono a carico del cliente, salvo accordo scritto contrario.
4. Ordine e conclusione del contratto
L’invio di un formulario, di una richiesta di pagamento o di un ordine costituisce una richiesta d’acquisto. Il contratto è concluso quando Swiss Art Gallery conferma per iscritto la disponibilità dell’opera e l’accettazione dell’ordine. Una conferma tecnica di ricezione non vale accettazione se lo precisa.
Il pagamento avviene tramite il mezzo proposto, in particolare TWINT, o secondo le istruzioni scritte. L’opera può essere bloccata temporaneamente durante la verifica del pagamento. Se il pagamento non è completato nel termine indicato, la galleria può liberare l’opera dopo aver informato il cliente.
Se l’opera non è disponibile o l’ordine non può essere eseguito, gli importi già incassati per l’ordine sono rimborsati.
5. Prenotazioni e offerte
Prenotazione
Una prenotazione blocca in linea di principio l’opera per 24 ore. L’acconto visualizzato è imputato sul prezzo finale. Se la galleria non può concludere la vendita, viene rimborsato integralmente. Se il cliente non finalizza entro il termine, la prenotazione decade; dopo aver contattato il cliente, l’acconto è trattato in buona fede in funzione dei costi e del danno effettivamente giustificabili.
Offerta di prezzo
L’offerta del cliente non è né un acquisto né una prenotazione e l’opera può restare disponibile. Se la galleria accetta o formula una controfferta, il cliente dispone del termine comunicato, in principio 48 ore, per confermare. La conferma con accettazione delle condizioni diventa una richiesta ferma e riserva l’opera durante il pagamento.
6. Acquisizione di più opere
La prima fase raggruppa unicamente le opere e la modalità di consegna. Il riepilogo, le eventuali spese e il totale sono mostrati nella seconda fase, prima della conferma contrattuale. La consegna fuori dalla Svizzera richiede un preventivo personalizzato.
7. Ritiro, consegna e trasferimento dei rischi
Il ritiro privato a St-Prex è gratuito su appuntamento. Per la Svizzera, il costo è mostrato o confermato prima dell’impegno. Per l’estero o un trasporto speciale occorre accettare un preventivo separato.
Il cliente fornisce un indirizzo corretto e permette la consegna. La galleria prepara un imballaggio idoneo e può incaricare un trasportatore. Il rischio passa con la consegna effettiva al cliente o alla persona da lui designata, fatti salvi i diritti imperativi. Ogni danno apparente va segnalato subito, conservando imballaggio e fotografie.
8. Buoni regalo
I buoni sono emessi in CHF con un codice individuale per importi da CHF 20 a CHF 5.000. Possono essere utilizzati in una o più volte, fino al saldo disponibile, per dieci anni dall’emissione. Non sono rimborsabili in contanti, salvo obbligo legale. Il titolare deve proteggere il codice e segnalare rapidamente perdita o uso non autorizzato.
9. Annullamento e resi
Il diritto svizzero non prevede un termine generale di recesso per gli acquisti online. Swiss Art Gallery non accorda quindi un diritto automatico di restituzione per ripensamento, salvo accordo scritto. Restano salvi i diritti imperativi eventualmente applicabili al domicilio di un consumatore straniero.
La galleria esaminerà comunque ogni richiesta motivata e cercherà una soluzione amichevole se lo stato dell’opera e le circostanze lo consentono.
10. Stato, verifica e garanzia
Le opere antiche o di seconda mano possono mostrare normali tracce di età, uso, restauro o incorniciatura. Non costituiscono difetti se descritte o usuali per l’oggetto. Il cliente deve esaminare l’opera alla ricezione e segnalare rapidamente per iscritto, con fotografie, ogni difetto non annunciato.
Restano applicabili i rimedi legali per difetti. Nulla limita la responsabilità per dolo, colpa grave o responsabilità che non può essere esclusa per legge.
11. Autenticità, provenienza e diritto d’autore
Autore e provenienza sono indicati secondo le conoscenze ragionevolmente disponibili alla vendita. Un’attribuzione qualificata non è una garanzia assoluta di autenticità. La fattura riporta gli elementi essenziali concordati. L’acquisto dell’oggetto materiale non trasferisce diritti d’autore, d’immagine o di riproduzione.
12. Dati e comunicazioni
I dati necessari alla relazione, al pagamento, alla consegna e alla contabilità sono trattati secondo l’informativa sulla riservatezza. Comunicazioni e conferme elettroniche conservate dalle parti possono provare la transazione.
13. Diritto applicabile e controversie
Si applica il diritto svizzero, escluse le norme di conflitto. Le parti cercano dapprima una soluzione amichevole. In mancanza, sono competenti i tribunali designati dal diritto svizzero; restano integralmente salvi i fori imperativi del consumatore.
